These Terms govern your use of 365 Pause. Please read them — by creating an account or using the app, you agree to them. If you don't agree, please don't use the app.

1. Who we are

365 Pause (the “App”) is operated by UofHappy LLC, a limited liability company formed in the United States (“we”, “us”, “our”). These Terms cover the App, the website at 365pause.app, and any related services we provide (together, the “Services”). “You” means the person using them.

365 Pause was previously published as Zero Meditation. It is the same service under a new name, and existing accounts carry over.

Your use of the Services is also subject to our Privacy Policy, which forms part of these Terms.

2. What 365 Pause is

365 Pause generates short guided meditations. You describe how you feel, choose a length, and the App writes and narrates a meditation for that moment. It also keeps a record of your practice — the pauses you take, notes you add, and a year view of your consistency.

The App requires an internet connection. Meditations are generated on our servers and streamed to your device.

3. Not medical advice

365 Pause is a wellbeing app, not a medical device or a healthcare service. It does not diagnose, treat, cure, or prevent any condition, and nothing in the App is medical, psychological, or therapeutic advice. It is not a substitute for care from a qualified professional, and it is not a crisis service.

If you are experiencing a mental health crisis or thinking about harming yourself, please contact your local emergency number or a crisis line immediately. In the US you can call or text 988 (Suicide & Crisis Lifeline).

Meditation and breathing exercises are not right for everyone. If you have a medical or psychiatric condition, are pregnant, or have any concern about whether this practice suits you, speak to a professional first. Never use the App while driving or doing anything else that needs your attention, and stop if you feel unwell.

4. Your account

You need an account to use the App. You agree to give accurate information, keep your password secure, and take responsibility for what happens under your account. Tell us promptly at [email protected] if you believe someone else has accessed it.

You must be at least 13 years old to use the Services (16 in the European Economic Area and the UK). One account per person; accounts are not transferable.

5. Subscriptions and payment

Some features require a paid subscription. Subscriptions are sold and processed through the Apple App Store or Google Play, not by us directly. The price, billing period, and any free trial are shown before you confirm the purchase.

We never see or store your card details. Purchases through Apple are subject to Apple's terms and privacy policy; purchases through Google Play are subject to Google's.

6. AI-generated meditations

Meditations in 365 Pause are generated by artificial intelligence, using your check-in as the prompt. This means:

7. Your content

Your check-ins, chosen moods, notes, and practice history are yours. You grant us a limited licence to store and process that content only to operate the Services for you — generating your meditations, showing your history, and keeping the service reliable and safe.

We do not sell your content, and we do not publish it. See the Privacy Policy for exactly what we collect, who processes it, and how to delete it.

We own the App, the website, our name and branding, the underlying software and prompts, and the ambient audio and design that come with it. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial use, subject to these Terms. Nothing here transfers ownership of anything to you.

The meditations generated for you are yours to listen to and keep for your personal practice. You may not sell them, publish them as your own, or use them commercially.

10. Availability and changes

We work to keep the Services running, but we don't promise they'll be uninterrupted or error-free. We may change, suspend, or discontinue features, and we may impose reasonable usage limits — for example on how many meditations can be generated in a period — to keep the service sustainable.

We may update these Terms. If a change is material, we'll give notice in the App or by email before it takes effect. Continuing to use the Services after that means you accept the updated Terms.

11. Ending your use

You can stop at any time. To delete your account and its data, use the delete option in the App or the page at 365pause.app/delete. Deleting your account does not automatically cancel a subscription — cancel that in your Apple or Google account settings.

We may suspend or terminate your access if you breach these Terms, if we're required to by law, or if we discontinue the Services. If we discontinue the Services entirely, we'll give reasonable notice where we can.

12. Disclaimers and liability

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your requirements or that generated content will be accurate or suitable for you.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the twelve months before the claim, or US$50.

Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you. Nothing in these Terms limits liability for fraud, or for death or personal injury caused by negligence, where that limitation would be unlawful.

You agree to indemnify us against claims, losses, and reasonable legal costs arising from your misuse of the Services or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Texas and the United States, without regard to conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Texas, unless the mandatory law of your country of residence gives you the right to bring proceedings elsewhere.

If any provision of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision isn't a waiver of it.

Apple-specific terms. If you downloaded the App from the App Store: these Terms are between you and us, not Apple; Apple has no obligation to provide support for the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
